1. Subject of the Regulations


a. These regulations define the terms and conditions for purchasing entry to and participating in events (Workshops/Events). If the terms and conditions of participation are also specified in other documents, such as the Event description, venue regulations, registration form, or order for Event-related services, these regulations will supplement these documents and apply to matters not regulated therein. Where specific Event participation and related services are subject to payment, the aforementioned documents describe the terms and conditions for the performance and settlement of mutual benefits.

b. The event organiser is the MIX Vocalists Association (Association), whose identification details are provided below:

c. The Regulations apply to events such as conferences, symposiums, workshops and training.(also online)for which the Organizer has reserved acceptance of these Regulations or has made them available in connection with a given Event in a manner enabling storage and reproduction in the ordinary course of business. In case of doubt, acceptance of the Regulations is also expressed by participation in the Event or payment of the fee for participation in the Event or services related to it.

d. Unless otherwise stated in the Regulations, they are binding on all Event Participants (Consumers), i.e. persons who register for the Event, including those on behalf of someone else or as representatives of an institution or company, or who actually participate in the Event as visitors, spectators, guests, exhibitors, partners, sponsors, moderators, speakers or their representatives (Participant). In case of doubt, any person who has expressed the will to enter the premises is considered a Participant (or online events) where the Event is taking place and who was allowed into the area.

e. Only an adult person may participate, unless the Organizer grants individual consent to participate also to other persons in consultation with the legal guardians of the minor Participant.

f. The Organizer allows the participation of volunteers, including underage volunteers, who will not require the consent of their legal guardians to participate.


2. Registration and participation in the Event


a. Participation in the Event is contingent upon registration by completing the registration form submitted to the Organizer via the online registration system or in another manner specified by the Organizer. In the case of paid Events or participation, participation or obtaining additional services related to the Event will require (in lieu of or in addition to registration) placing an order, paying the appropriate fee, or presenting confirmation of the transaction and sending it to zapisy@mix.org.pl.

b. The Organizer specifies in the registration form, order, or otherwise the Participant's requirements and data required to register for a given Event, acquire the right to participate in the Event, or use specific services. If justified by the nature of the Event, the free nature of participation, or venue-related restrictions, the Organizer may refuse registration or make registration of a given person contingent upon additional verification, additional consent to use the data, or a specific registration deadline.

c. If registering on behalf of another person and entering someone else's data, the person entering such data warrants that they have obtained the appropriate authorization to register, create an account, or submit the declarations required for registration, and is responsible for any consequences of entering data contrary to such authorization. If registering for more than one person, the person registering should submit separate registrations for each person (with a separate account/email address for each person registered for the Event).

d. For certain types of participants, e.g., journalists, exhibitors, guests, speakers, the Organizer may provide special rules for registration or access to facilities, in particular by registering them by the Organizer itself or by using additional identifiers confirming the right to access specific services (e.g., a photograph). If a Participant is registered by the Organizer, it will be based on data provided by the Participant, their representative, or publicly available data.

e. Information and declarations related to participation in the Event or ordering additional services related to it will be sent to the Participant's email address. A declaration sent to such an email address is deemed delivered to the Participant registered using that address. Any change to this address requires notification to the Organizer.

f. Participant data collected during registration and in connection with participation in the Event will be processed in accordance with the Organizer's Privacy Policy, which constitutes an integral part of these Regulations. Each Participant should familiarize themselves with the Privacy Policy available on the website mix.org.pl

g. The participant is personally responsible for providing the equipment necessary to participate in the online part of the workshop, i.e. a computer, internet connection and a web browser or possibly an application used to connect to the event, e.g. Zoom or other.

h. The Organizer does not provide accommodation and meals to Participants during the live workshops, unless such an option is included in the Event offer for a fee.

h. The Organizer, if so chosen, may provide access to workshop recordings for a period specified in the offer on the mix.org.pl website for a specific event. If the Organizer offers workshop recordings, Participants will receive a link with access to them, without the option to download the files, for a maximum of one month after the event ends.

i. The Participant will receive a certificate of participation in the Event within 21 days of the event's conclusion. The Participant has the right to amend their name if there are any errors on the document.

 

3. Rights and obligations of the Organizer and Participants


a. Unless the terms and conditions of participation in a given Event provide otherwise, the Organizer shall provide the participant with access to the appropriate parts of the facility where the Event takes place and a form of participation and contact with other participants appropriate to the nature of the Event, in exchange for open participation in the Event and enabling contact withandto the Organizer and other participants. Anonymous participation in the Event is excluded, except in special cases and with the Organizer's consent. During the online portion, Participants are required to use their full name and surname, and the data provided must match those provided during registration.

b. To ensure safety, comfort, and the ability to verify Participants' eligibility, the Organizer identifies them, for example, through individual accounts in the online registration service or personalized ID badges. The Organizer reserves the right to verify the Participant's identity and their eligibility to enter the facility or services related to the Event, for example, by requesting their ID badge. If a Participant fails to provide all required data during registration, refuses to provide their ID badge, or if doubts arise as to the consistency of their data with the data on the ID badge, the Organizer reserves the right to verify their identity in other available ways, for example, by asking the Participant for identification during the Event.

c. The Event will be recorded photographically and using audio/video devices, and may be broadcast on radio, television, or other means enabling public access so that everyone can access it at a place and time of their choosing (e.g., online/social media/Association's website). Participation in the Event is public, so the silhouette or image of a Participant, whether individually or as part of a larger whole, may be intentionally or accidentally documented photographically, audio, or video, and materials obtained in this way may be disseminated by the Organizer and press representatives for informational and promotional purposes related to the Event, other Events, and the activities of the Organizer, sponsors, and Event partners (including via websites, email, social media, and in print). Regardless of the above, the Event may also be monitored for security reasons.

d. The Organizer assumes that the Participant taking part in the Event accepts the possibility of recording and using his/her silhouette or image as a participant of the Event as indicated above.

e. If, in connection with registration for the Event, participation or use of services related to the Event, the Participant provides the Organizer with any materials, e.g. items, biographies, photographs, graphics or recordings, for the purpose of their use or sharing in connection with a given participation, such transfer shall constitute authorization for the Organizer and the sponsors and partners of the Event to use them in accordance with the agreed purpose, including within the framework of services informing about the Event and recording or monitoring the course of the Event as above. The Participant guarantees that the use of these materials as above will not infringe any rights of third parties.

f. Access links to online events and training materials, including workshop recordings, are protected under the provisions of the Polish Act on Copyright and Related Rights and European Union law, in particular Directive 2001/29/EC. These materials are intended solely for the personal use of the Participant. It is prohibited to share, distribute, copy, record, reproduce, or otherwise make them available to third parties, in whole or in part, without the prior written consent of the Organizer. In particular, it is strictly forbidden to share access links enabling participation in the event with unauthorized persons. The Participant acknowledges that any breach of the above provisions constitutes an infringement of economic copyrights within the meaning of Article 17 of the Act on Copyright and Related Rights and may result in liability under Article 79 of that Act. Furthermore, pursuant to Article 353¹ of the Polish Civil Code, the Organizer reserves the right to immediately revoke the Participant’s access to the event and materials without any refund, as well as to pursue claims under general legal provisions


4. Rules of order


a. Participants may move around the premises only within publicly accessible and designated spaces and passageways, in accordance with the instructions of the Organizer and the facility manager.

b. Event participants should take part inThe eventopenly and personally, in particular they may not assign rights or part of rights related to registration or services within the Event to other persons or transfer IDs or tickets to personsthirdTransferring rights to other entities will only be possible due to unforeseen circumstances beyond the participant's control, after approval by the Organizer.

c. Subject to specific conditions in force in designated areas of the Event venues or individual consent from the Organizer, the following are prohibited on the Venue: smoking, using electronic cigarettes, consuming alcohol, blocking circulation and evacuation routes, using open flames and gas cylinders, using makeshift electrical installations, bringing chemicals into the exhibition area, and blocking access paths to fire protection equipment and evacuation passages. The Organizer alone determines the conditions and locations where smoking, consuming alcohol, or any of the above-mentioned behaviors may be permitted.

d. It is prohibited to bring weapons, pyrotechnics, and other hazardous materials into the Event venues, including those that may cause fire, property damage, or harm the health of participants or other persons. This also applies to equipment and materials related to assembly, adaptation, or disassembly, which may involve the use of high temperatures or flammable chemicals. In justified cases, bringing the aforementioned equipment or materials into the venues will be permitted with special permission from the Organizer and the venue manager, and provided that their use is ensured by persons with appropriate authorizations and security measures. Except as expressly permitted by the Organizer, it is prohibited to move or remove any equipment or equipment related to the Event from the venues or designated areas.

e. The Organizer is not responsible for the protection of persons and property, and therefore for any accidents to persons, theft or damage to property on the premises where the Event takes place, unless the damages related thereto were caused solely by the Organizer or the Organizer has undertaken to provide specific security measures in a separate order.

f. The Organizer is entitled to refuse entry to the premises where the Event is taking place or to remove from the premises any person who is intoxicated or under the influence of other intoxicants, or any person who is presenting a third party ID,

refuse to present an ID or other identification document, or any person whose behavior is aggressive, violates the rules of social coexistence, or poses a risk to personal rights, property, health, order, or public morality. In the above cases, the Organizer is entitled to report the incident to security or law enforcement agencies. The Organizer is not liable for any damages to participants resulting from the refusal to admit or removal of an individual from the Event venue; nor is the Organizer obligated to refund any fees paid in connection with such participation.


5. Complaints


a. A consumer who has concluded a distance contract(in accordance with the Consumer Rights Protection Act)may withdraw from it within 14 calendar days without giving any reason and without incurring any costs, except for the costs of deducting the commission charged by the payment intermediary - Przelewy24.

To meet the deadline, it is sufficient to send a declaration before its expiry to the e-mail addresszapisy@mix.org.plRefunds will be issued after the Organizer receives bank transfer details from the person submitting the claim. These bank transfer details should be included in the claim.

b. If the Participant purchased entry to an event online and received a link to this event via email, the declaration should also include the Participant's assurance that he or she will not use the link and will not enter the Event in a manner inconsistent with the Regulations.

c. The Organizer shall immediately, no later than within 14 calendar days from the date of receipt of the Consumer's declaration of withdrawal from the Agreement, refund the payments made by the Consumer, less the commission and in accordance with the principles set out in point 5a of the Regulations.

d. If the Participant terminates the Agreement no later than 15 calendar days before the Event, the Price paid for participation in the Event will be refunded by bank transfer to the account number indicated by the withdrawing Participant in the declaration sent by e-mail to the e-mail address indicated above.

e. A declaration of termination of the Agreement submitted later than 15 calendar days before the Event does not oblige the Organizer to refund any part of the amount paid by the Participant, nor does it release the Participant from paying the entire amount, as it covers the costs incurred by the Organizer in connection with the organization of the Event.

f. If a Participant cancels their participation in the Event later than 15 calendar days before its commencement, they are not entitled to a refund of the fee paid, but they may transfer their right to participate to another person. The conditions for a successful transfer of the right are:

obtaining the person's consent to participate
sending a message from the new Participant to the Organizer’s e-mail address (zapisy@mix.org.pl) containing his/her data required for registration (name, surname, address, telephone number and, if necessary, data required for issuing a VAT invoice)
acceptance of these Regulations by the new Participant
Once the above conditions are met, the right to participate is transferred to the new Participant.

g. The Participant to whom the rights have been transferred (point 5f) loses the possibility of filing a complaint due to failure to meet the requirements listed in point 5e.

 


6. Final provisions


a. The Organizer reserves the right to close registration at any time and to cancel, shorten, or change the date or schedule of the Event in the event of force majeure preventing the Event from taking place, in the event of a threat to the life or health of participants, or without providing a reason. In these cases, the Organizer is not liable for any losses incurred by participants resulting from the cancellation or change of Event dates, including costs related to transportation or hotel reservations.

b. In the event of the Event being cancelled, the Organizer is obliged to refund any fees/advances already paid to the Participants, less the commission charged by the payment intermediary - Przelewy24.

c.The organizer reserves the right to invite selected individuals despite their failure to pay. Invitations may be granted to special guests, experts, media partners, sponsors, or winners of competitions organized by the Association. The free option may not include additional benefits, such as access to workshops, conference materials, recordings, or certificates.
